Habitual Traffic Offender

A habitual traffic offender (HTO) is a designation given to individuals who accumulate a certain number of specified traffic offense convictions within a certain period

The Florida Department of Highway Safety and Motor Vehicles (DHSMV) is responsible for monitoring and enforcing the habitual traffic offender status.


The criteria for being designated as a habitual traffic offender in Florida include:

  • Three Major Offenses: Accumulating three convictions of certain major traffic offenses within a five-year period. Major offenses include driving under the influence (DUI), vehicular manslaughter, and driving with a suspended or revoked license.

  • 15 Convictions for Moving Violations: Accumulating 15 convictions for moving traffic offenses for which points are assessed within a five-year period. Moving violations include speeding, reckless driving, and other offenses that result in points on your driving record. 


Once an individual is designated as a habitual traffic offender, their driver's license is revoked for a specified period, typically five years. An attorney may help advise you on if you can remove the Habitual Traffic Offender designation or avoid being designated as a Habitual Traffic Offender in the first place.
