Pre-Sentence Investigation

The purpose of a PSI is to gather information about the defendant's background, circumstances, and the nature of the offense committed.

In Florida, a pre-sentence investigation (PSI) is a process conducted by the state's Department of Corrections. It occurs after a defendant has been found guilty or has pled guilty to a crime. The purpose of a PSI is to gather information about the defendant's background, circumstances, and the nature of the offense committed.

During a PSI, a probation officer or investigator collects information by interviewing the defendant, reviewing court records, contacting victims, speaking with witnesses, and assessing the defendant's criminal history, education, employment, family situation, mental health, and substance abuse history.

The information collected during the pre-sentence investigation is used to help the judge make an informed decision about an appropriate sentence. The PSI report provides the judge with insights into the defendant's character, circumstances, and the potential risks they may pose to society. This information helps the judge determine whether to impose probation, incarceration, or other forms of punishment, and it may also influence decisions regarding rehabilitation or treatment programs.
